the benefits of, or be otherwise subjected to discrimination under any program or activity
receiving Federal Financial assistance from the Coast Guard. It is also the policy of the
Coast Guard to comply with the policy, guidance and regulations published by the Secretary
of Homeland Security regarding Title VI and Title IX, references (e) and (f), which are made
a part hereof by this reference.
7. RESPONSIBILITIES.
a. The Assistant Commandant for Civil Rights [hereafter, "Commandant (G-H)"] shall, in
accordance with references (a) through (h), and other applicable law, including the
Privacy Act, as amended (5 U.S.C. 552a):
(1) Provide leadership to the Coast Guard and policy guidance to the Commandant
regarding compliance with civil rights-related statutes, regulations and other
requirements in Coast Guard programs of Federal financial assistance;
(2) Coordinate and respond to the Coast Guard-wide reporting requirements under
references (a) through (f) and (h);
(3) Conduct investigations and compliance reviews and make determinations involving
issues and complaints of non-compliance covered by references (a) through (f) as
assigned by the Secretary of Homeland Security; and
(4) Make determinations regarding Coast Guard jurisdiction over issues and complaints
covered by references (a) through (f) and (h) involving the Coast Guard's programs
of Federal financial assistance and refer any issues or complaints that are not within
the Coast Guard's jurisdiction to the DHS, Department of Justice, or other Federal
agencies for appropriate action.
b. Area and district commanders, commanders of maintenance and logistics commands,
commanding officers of integrated support commands and headquarters units, assistant
commandants for directorates, Chief Counsel and special staff elements at Headquarters
shall:
(1) Respond to reporting requirements established by the Commandant (G-H),
Secretary of Homeland Security, or the Attorney General, under authority of E.O.
12250, and the Department of Justice's Government-wide implementing
regulations, reference (h);
(2) Ensure that applicants for Federal financial assistance, as a condition of the approval
for and/or extension of any Federal financial assistance from the Coast Guard,
comply with the requirements of references (e) and (f), including the submission of
signed assurances and/or other civil rights-related documentation; and
(3) Refer any issues or complaints involving allegations of noncompliance with
references (a) through (f) to the Commandant (G-H) for appropriate action.
