46 U.S.C. 2107 sets forth factors that must be
considered when a penalty is assessed. These factors
are: the nature, circumstances, extent, and gravity of
the prohibited acts committed and, with respect to the
violator, the degree of culpability, and history or
prior offenses, ability to pay, and other matters that
justice requires.
